The Labor Ministry has issued an instruction affirming that the minimum wage in Spain for 2024, set at EUR1,134 per month, continues to be valid despite recent legislative challenges. The decision follows the rejection of the omnibus decree by the Congress, which had implications for various measures, including pension increases and wage regulations.
With the annulment of the decree by the Popular Party (PP) and Junts, there were concerns regarding the status of the minimum wage. However, the Labor Ministry clarified that the absence of a new wage regulation does not eliminate the existing minimum wage. This is crucial as the government is still in negotiations with unions and employers regarding potential wage adjustments for 2025.
The directive, signed by María Nieves González García, the Director General of Labor, emphasizes the fundamental principle that a legal minimum wage must exist to protect workers' rights. The Ministry references both national laws and international agreements, including the Spanish Constitution, which guarantees workers a fair remuneration sufficient to meet their needs and those of their families.
Furthermore, the instruction highlights the importance of maintaining the minimum wage's applicability to all existing contracts and new agreements made during this transitional period, where no new wage amount has been established. Specifically, it states that existing contracts will not be affected by the annulment and that any new employment agreements should not reference salaries below the established EUR1,134 minimum wage.
The Labor Ministry also announced that the Labor Inspectorate will actively monitor compliance with the minimum wage requirements. Businesses contemplating contracts that offer less than the minimum wage are warned that inspections will be conducted to ensure adherence to labor laws.
